2024 RAPALA BASSMASTER FANTASY FISHING CHALLENGE
NO PURCHASE NECESSARY TO PLAY OR WIN. THE FOLLOWING PROMOTION IS A GAME OF SKILL INTENDED ONLY FOR LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING WITHOUT LIMITATION, ALASKA, HAWAII, PUERTO RICO AND OTHER U.S. TERRITORIES AND FOREIGN TERRITORIES) ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.
These are the official rules (the “Official Rules”) for the 2024 RAPALA BASSMASTER FANTASY FISHING CHALLENGE (the “Promotion“). The Promotion is sponsored by B.A.S.S., LLC, 3500 Blue Lake Dr., Suite 330, Birmingham, AL 35243 (“Sponsor“). To the extent any advertisers are associated with the Promotion, including, but not limited to, Rapala, each such advertiser shall be deemed a “Promoter” for purposes of these Official Rules.
- ELIGIBILITY. The Promotion is open to legal residents of the 48 contiguous United States and the District of Columbia (EXCLUDING, WITHOUT LIMITATION, SUCH RESIDENTS OF ALASKA, HAWAII, PUERTO RICO AND OTHER U.S. TERRITORIES AND FOREIGN TERRITORIES), who are 18 years of age or older as of the date of entry, (an “Entrant,” “Player” or “You“). Registration is further described below. The following are not eligible to participate or win in this Promotion: (i) employees and agents of Sponsor, US Sweepstakes & Fulfillment Co. (the “Administrator”), Promoter or Promoters and their respective parent, subsidiary and affiliated companies, franchisees and licensees, and its respective advertising/promotion agencies (collectively the “Promotion Entities”); and (ii) the “immediate family members” and/or “household members” of any of the persons set forth in (i) above. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings or spouses. “Household members” shall mean people who share the same residence at least three (3) months a year. The Promotion is void where prohibited by law. Participation in the Promotion constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions. The decisions of the Sponsor regarding all matters relating to the Promotion are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
- PROMOTION PERIOD. The Promotion Period begins on Friday, December 1, 2023 at 12:01 p.m. Eastern Time (“ET”) and ends on Thursday, August 15, 2024 at 6:00 a.m. ET or, if the last tournament of the season is rescheduled, the Promotion Period will end at 6:00 a.m. ET on the first day of the last tournament (the “Promotion Period”).
- PROMOTION DESCRIPTION. The Promotion will consist of ten (10) separate tour events (each a “Tournament”, and, collectively the “Tour”) during the period of February 22, 2024 through August 18, 2024* (the “Season”). *Season dates are subject to change. For each Tournament, prizes will be awarded to the twenty (20) Players who accumulate the greatest number of points as specified below in Section 7, Tournament Winner Determination. For the Season, prizes will be awarded to the five (5) Players who accumulate the greatest number of points for each tournament combined as described below in Section 8, Finisher Runner-Up and Grand Prize Winner Determination.
- REGISTRATION: To access the Promotion, visit Bassmaster.com and click on the link to “Fantasy Fishing” to visit the Fantasy Fishing Website (the “Fantasy Fishing Website”). Or, visit https://bassmasterfantasy.com/ to visit the Fantasy Fishing Website. To enter the Promotion, you must set up an account (the “Fantasy Fishing Account”).
If you do not have a Fantasy Fishing Account, you may register by clicking on the applicable link as indicated on the Promotion entry page and following the instructions. You will be asked to provide your name, e-mail address, mailing address, phone number and to select a username and password. You are responsible for the secrecy of your password. Sponsor, Administrator, Promoters and other third parties are not responsible or liable for any actions taken using your password. By signing up for a Fantasy Fishing Account, you consent to receive promotional emails from B.A.S.S., Promoters and select B.A.S.S. partners.
- PROMOTION DEFINITIONS
- “Tour” shall refer to the Bassmaster Tournament Trail.
- “Tournament” shall refer to one of the ten (10) fishing tournaments consisting of nine (9) Bassmaster Elite Series tournaments plus the Bassmaster Classic tournament.
- “Entrant” or “Player” shall refer to a person who has entered the Promotion in compliance with these Official Rules.
- “Angler” or “Professional” shall refer to a real person who participates in the Tour or a Tournament upon which the Promotion is based.
- “Team” or “Roster” shall refer to a team of exactly five (5) Professionals chosen by a given Entrant for a particular Tournament.
- “Season Ranking” shall refer to the cumulative results of the Promotion based on all Tournaments to date.
- “Catch” shall refer to the total fish caught by a Professional and submitted by him for weigh-in on a given day of a Tournament.
- HOW TO PLAY: a. General. The objective of the Promotion is to accumulate the most points (see “Scoring” below) over the course of each Tournament listed below.
b. Entry. You may enter the Promotion by first logging in to your Fantasy Fishing Account with your username and password during the Promotion Period and completing the entry by clicking on the “Create Team” button.
c. Select Your Anglers. For each Tournament, you must select five (5) Anglers to form a complete Roster per the Tournament schedule below (an “Entry”). All Rosters are divided into five (5) angler groupings, each a “Group”.
- Group A – select one (1) Angler.
- Group B – select one (1) Angler.
- Group C – select one (1) Angler.
- Group D – select one (1) Angler.
- Group E – select one (1) Angler.
Rosters may be changed at will without penalty prior to each event’s “Locktime” as defined in the chart below. An angler’s group designation may change for each event of the Promotion.

d. Scoring. Each Player will have points added or deducted based on his or her selected Team members’ performance and the results of the Bonus Points Question, as described below. Standings are determined by a system that awards points based on final standings in each Bassmaster Elite Series event. The Players also will earn points for the 2024 Academy Sports + Outdoors Bassmaster Classic event based on a similar but modified scoring system as there are fewer anglers competing.
The system awards 300 points to the winner of each Tournament, with a five-point decrease per position through fifth place, which receives 280 points. There is a four-point decrease from sixth (276) to 10th place (260), and a three-point decrease per position from 11th place (257) to 15th place (245), and a two-point decrease per position from 16th place through the rest of the field. Anglers who finish in a tie receive points based on a formula that adds the points of the affected positions and divides the total by the number of anglers tied for the position. The resulting number represents the number of points awarded to each angler in a tie. An angler must weigh a legal fish to register points, and those who do not are not awarded points for the tournament.
For each day they lead a tournament, five bonus points are added to an angler’s total, including the final day. Anglers who do not catch any fish in a tournament do not receive points.
Forty (40) bonus points will be added to the angler’s total who catches the heaviest fish of each tournament.
A ‘Big Bag’ bonus of forty (40) bonus points will be added to the angler’s total who has the highest 1-day total weight of each tournament.
Season Rankings are cumulative of all Elite Series events, from Elite Series tournament #1, Toledo Bend Reservoir, through Elite Series tournament #9, St. Lawrence River, and the 2024 Academy Sports + Outdoors Bassmaster Classic (the “Bassmaster Classic”).
In the event a tournament is cancelled for reasons beyond the control of the Sponsor, there will not be Individual Event Prize Winners for the applicable tournament.
e. Bonus Points Question. Players will be given the opportunity to guess the Tournament’s winning weight during the entry process and prior to each Tournament’s Locktime (the “Bonus Points Question”). Answering the Bonus Points Question is optional. If a Player correctly guesses the applicable Tournament’s winning weight, he/she will receive 40 bonus points towards his/her Tournament score.
f. Locktime. All Roster changes must be completed by 6:00 a.m ET on the first day of each event, as shown in the chart above. Selections submitted after Locktime are considered invalid. If a Player has not set his or her Team by Locktime, the Player’s Roster will be left blank, and zero points will be awarded for that tournament.
g. Tiebreaker: Players will be given the opportunity to answer one (1) tie-breaker question during the entry process (Tiebreaker #1 below). Answering the tie-breaker question is optional. If a player chooses not to answer the tie-breaker question, he/she will be given a score of zero (0) for Tiebreaker #1 below.
In the event of a tie, the pool of tied players will be reduced until only one (1) potential winner for each prize remains by applying the tie-breaker rules below in the order listed. In all cases, an entry that does not win a tiebreaker is eliminated from consideration.
Tournament and Season Tiebreakers:
For both the Tournament and Season prizes, the tiebreakers will be:

- Tiebreaker #1: Closest to total weight of submitted fish for the official weigh-in by the winning angler, in pounds and ounces.

- Tiebreaker #2: Highest total number of fish submitted for the official weigh-in by the anglers selected in the entrant’s roster.

- Tiebreaker #3: Highest total weight of submitted fish for the official weigh-in by the anglers selected in the entrant’s roster.

- Tiebreaker #4: The entrant whose date of entry creation was recorded in the system the earliest
h. Umpires and referees. The decisions of the officials responsible for officiating each Tournament shall be final and legally binding regarding the outcome and scoring of each event.
THERE IS A LIMIT ONE (1) ENTRY PER PERSON PER TOURNAMENT (REGARDLESS OF THE NUMBER OF EMAIL ADDRESSES OR REGISTERED FANTASY FISHING ACCOUNTS). If more than (1) entry is received per person or e-mail address per tournament, that person will be disqualified and not be eligible to win a prize. Potential winners may be required to provide Sponsor with proof that they are the registered individual associated with the winning entry. Entries made by any other individual or any entity, including but not limited to commercial subscription notification and/or entering services, will be declared invalid and disqualified for this Promotion. Tampering with the entry process or the operation of the Promotion is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. Sponsor’s computer shall be the official timekeeper for all matters related to this Promotion. Entries generated by a script, macro, or other automated means will be disqualified.
Sponsor and its agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of Sponsor and will not be returned.

- TOURNAMENT WINNER DETERMINATION:
Individual Tournament First Prize Winners: The Player that accumulates the highest number of points during each Tournament will be determined to be a potential Individual Tournament First Prize Winner.
Individual Tournament Second Prize Winners: The Players that accumulate the second through fifth highest number of points during each Tournament will be determined to be a potential Individual Tournament Second Prize Winner.
Individual Tournament Third Prize Winners: The Players that accumulate the sixth through tenth highest number of points during each Tournament will be determined to be a potential Individual Tournament Third Prize Winner.
Individual Tournament Fourth Prize Winners: The Players that accumulate the eleventh through twentieth highest number of points during each Tournament will be determined to be a potential Individual Tournament Fourth Prize Winner.

- FINISHER RUNNER-UP AND GRAND PRIZE WINNER DETERMINATION:
Finisher Runner-Up Prize Winners: The four (4) players that accumulate the second through fifth highest number of points during the Tour, including the entire Elite Series Tournament Season and the Bassmaster Classic, will be determined to be the potential Finisher Runner-Up Prize Winners.
Grand Prize Winner: The Player that accumulates the highest number of points during the Tour, including the entire Elite Series Tournament Season and the Bassmaster Classic, will be determined to be the potential Grand Prize Winner.

- PRIZE(S)/APPROXIMATE RETAIL VALUE (“ARV”):
Individual Tournament First Prizes: There is one (1) Individual Tournament First Prize available to be won per Tournament. Each Individual Tournament First Prize winner will receive a prize package to include:
- One (1) $2,500 Bass Pro Shop Gift Card;
- $1,000 cash (to be awarded in the form of a check);
- Rapala prize package including the following (ARV: $500)
- One (1) Rapala Touch Screen Scale with culling kit;
- One (1) Rapala Performance Tool Combo;
- One (1) Rapala Ruler;
- One (1) Rapala Decal Kit;
- One (1) Rapala Trucker Cap; and
- One (1) Rapala Products Package including Crankbaits, Jerkbaits, Sufix Line, VMC Hooks, Terminator Jigs, and Storm Lures.
If an Individual Tournament First Prize winner is a B.A.S.S. Member as of the corresponding Individual Tournament Locktime, as indicated in the chart above, he/she will receive an additional $500 Bass Pro Shop Gift Card. The total ARV of each Individual Tournament First Prize is: $4,000 minimum / $4,500 maximum.
Individual Tournament Second Prizes: There are four (4) Individual Tournament Second Prizes available to be won per Tournament. Each Individual Tournament Second Prize winner will receive a prize package to include:
- One (1) Rapala Touch Screen Scale with culling kit;
- One (1) Rapala Performance Tool Combo;
- One (1) Rapala Ruler;
- One (1) Rapala Decal Kit;
- One (1) Rapala Trucker Cap; and
- Rapala Brands Products valued up to $100.
The total ARV of each Individual Tournament Second Prize is: $250.
Individual Tournament Third Prizes: There are five (5) Individual Tournament Third Prizes available to be won per Tournament. Each Individual Tournament Third Prize winner will receive Rapala Brands Products of Sponsor’s choice valued up to $100. The total ARV of each Individual Tournament Third Prize is: $100.
Individual Tournament Fourth Prizes: There are ten (10) Individual Tournament Fourth Prizes available to be won per Tournament. Each Individual Tournament Fourth Prize winner will receive a prize package to include:
- One (1) Rapala Cap;
- One (1) Rapala T-shirt; and
- Three (3) Rapala products of Sponsor’s choice.
The total ARV of each Individual Tournament Fourth Prize is: $50.
Finisher Runner-Up Prizes: Each of four (4) Finisher Runner-Up Prize winners will receive a prize package to include:
- One (1) $1,000 Bass Pro Shops Gift Card; and
- One (1) Rapala package including a Rapala hat, t-shirt and lures.
The total ARV of each Finisher Runner-Up Prize is: $1,100.
Grand Prize (top Season total): One (1) Grand Prize Winner will receive a prize package to include:
- One (1) $15,000 Bass Pro Shops Gift Card;
- $5,000 cash (to be awarded in the form of a check);
- One (1) Rapala package including a Rapala hat, t-shirt and lures; and
- A trip package for one (1) person, the Grand Prize winner, to the 2025 Bassmaster Classic. Location and dates of the 2025 Bassmaster Classic have not yet been determined as of the time of drafting these Official Rules. Travel dates and location are to be determined by the Sponsor, in its sole discretion. Trip package will include:
- Round-trip, coach-class airfare (up to $500 in value) for Grand Prize winner to a to-be-determined location from a major airport nearest Grand Prize winner’s residence within the contiguous 48 U.S.;
- Two (2) nights hotel accommodations (up to $400 in value) at a hotel of Sponsor’s choice;
- One (1) special seating pass at the arena for the 2024 Bassmaster Classic weigh-ins; and
- Opportunity for Grand Prize winner to be interviewed by Ronnie Moore and Davy Hite during Bassmaster LIVE from the Classic Outdoors Expo.
If Grand Prize winner is a B.A.S.S. Member as of 6:00 AM ET on August 15, 2024, he/she will receive an additional $500 Bass Pro Shop Gift Card. The total ARV of the Grand Prize is: $21,000 minimum / $21,500 maximum. The ARV of the Grand Prize may vary based upon dates of travel and point of departure. The difference between the ARV and the actual value of the Grand Prize will not be awarded.
ONLY THE NUMBER OF PRIZES SET FORTH IN THESE OFFICIAL RULES WILL BE AWARDED IN THIS PROMOTION.
Total ARV of all prizes to be awarded: $85,400 Minimum ARV / $90,900 Maximum ARV.

- PRIZE CONDITIONS. Unless otherwise specified, prizes are not redeemable for cash, assignable, transferable and may not be substituted except at Sponsor’s sole discretion. No prize substitution except at Sponsor’s sole discretion due to prize unavailability for any reason, and only then for prize of comparable value. Sponsor reserves the right to award the actual cash equivalent of any prize in lieu of the prize itself. Prizes are awarded “AS IS” and WITHOUT WARRANTY OR GUARENTEE OF ANY KIND, express or implied, (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). All taxes associated with the receipt or use of any prizes are the sole responsibility of the winner.
Winners are solely responsible for any and all expenses relative to participation in the Promotion (including acceptance of any prize) not specified herein. EACH WINNER IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE. INDIVIDUAL TOURNAMENT FIRST PRIZE WINNERS, FINISHER RUNNER-UP PRIZE WINNERS AND THE GRAND PRIZE WINNER WILL BE REQUIRED TO FURNISH HIS/HER SOCIAL SECURITY NUMBER FOR THE SOLE PURPOSE OF PREPARATION OF ANY TAX FORMS AS REQUIRED BY LAW.
Gift Certificates/Cards are not redeemable for cash and will not be replaced if lost or stolen. Gift card/certificate usage is subject to the issuing company’s complete terms and conditions, including expiration dates.
Grand Prize Trip Conditions: All travel related expenses, including but not limited to, ground transportation, taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges, luggage fees, departure taxes, hotel, resort or property fees, food & beverage and personal expenses are the sole responsibility of Grand Prize winner. Grand Prize winner must have valid photo ID and any other required documentation prior to departure. Grand Prize Trip Package must be taken on dates specified by Sponsor or Grand Prize will be forfeited in its entirety. Dates are subject to change. Grand Prize winner must agree to abide by all air carrier, hotel, venue, transportation, and any other prize-related activity rules and regulations in effect. Failure to do so may result in forfeiture of prize and no other substitution or compensation will be provided in lieu thereof. Travel arrangements must be made through an agent of the Sponsor and on an airline carrier of Sponsor’s choice, if applicable. Sponsor will, in its sole discretion, determine which airport is closest to the Grand Prize winner’s home. In the event the Grand Prize winner’s residence is close enough to the to-be-determined location of the 2025 Bassmaster Classic, such that air transportation is deemed by Sponsor in its sole discretion to be unnecessary, the Sponsor reserves the right to substitute with gas/fuel reimbursement of up to $500 for ground transportation expenses. Grand Prize winner is responsible for obtaining any travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Photo identification and credit card or cash deposit may be required at any time for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Grand Prize). All hotel reservations are based on availability. Accommodations are subject to availability at time of reservation. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Reservations are subject to availability. If weather or other incident or conditions beyond the control of the Sponsor affects the ability for the Grand Prize winne to redeem any portion of prize during the scheduled date and time, then the Sponsor shall have no further obligation to the Grand Prize winner other than to supply the remaining elements of the prize package minus the unused portion of prize. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations. Sponsor is not liable for expenses incurred as a consequence of flight cancellation/delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of Sponsor. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by airline carrier as detailed in the passenger ticket contract. The passenger contracts in use by the airline or other transportation companies shall constitute the sole contracts with respect to the Grand Prize winner’s transportation and such contracts shall be solely between the Grand Prize winner, and such transportation companies. Trip components issued in connection with the Grand Prize may not be eligible for frequent flyer miles, other rewards programs or upgrades. If for any reason whatsoever, Grand Prize winner is unable to travel after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the Grand Prize winner. In the event the Grand Prize winner engages in behavior that, as determined by the Sponsor, in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of the Sponsor, Promoters, or any of Sponsor’s, or Promoters’ services, products, trademarks, service marks, or logos, the Sponsor reserves the right to terminate the trip early, whole or in part, and send the winner home with no further obligation or compensation whatsoever to Grand Prize winner. In the event the Grand Prize winner engages in behavior during travel that (as determined by the Sponsor in its sole discretion) is illegal, tortious, or subjects winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Grand Prize winner as a result of such conduct. If Grand Prize winner is unable to make the trip or is otherwise unavailable on the determined date, the Grand Prize will solely consist of the remaining Grand Prize elements and the trip package portion of the Grand Prize will be void and no other compensation will be provided in lieu thereof.
The Sponsor is not liable for any loss or penalties incurred if the 2025 Bassmaster Classic is delayed, cancelled or postponed for any reason, including but not limited to, acts of nature, acts of God, amenities, services and/or facilities not being available due to renovations, strikes or bankruptcy, mechanical difficulties, equipment unavailability, angler illness or the like. If the 2025 Bassmaster Classic is delayed, cancelled or postponed, Grand Prize winner will be notified as soon as possible. If it is not possible to substitute with an alternative date, Sponsor may cancel the 2025 Bassmaster Classic trip package portion of the Grand Prize and the Grand Prize will solely consist of the remaining Grand Prize elements and the trip package portion of the Grand Prize will be void and no compensation will be provided in lieu thereof. Notwithstanding anything to the contrary in these Official Rules or otherwise, Sponsor will not offer cash substitution or refunds or be liable in any way for expenses that Grand Prize winner incurs if the 2025 Bassmaster Classic is cancelled. 2025 Bassmaster Classic passes are not redeemable for cash, will not be replaced if lost or stolen and are subject to the issuing company’s terms and conditions. If the opportunity to be interviewed by Ronnie Moore and Davy Hite during Bassmaster LIVE from the Classic Outdoors Expo is changed or cancelled for reasons beyond the control of the Sponsor, the Grand Prize winner understands and agrees that the opportunity has NO CASH VALUE and that the Sponsor will not offer a replacement prize and that the Grand Prize will consist of only the remaining prize elements.

- MINORS. If a winner is age 18 or older and otherwise eligible under these Official Rules, but is nevertheless deemed a minor in their state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute and return a Minor Release on minor’s behalf, as applicable.

- CONDITIONS OF PARTICIPATION: Entrants agree to abide and be bound by the terms of these Official Rules and by the decisions of the Sponsor, which are final on all matters pertaining to this Promotion. This Promotion is governed by, and these Official Rules will be construed and interpreted pursuant to, the laws of the United States. All federal, state and local laws and regulations apply. All federal, state and local taxes, and all income and any other taxes, fees and surcharges will be the sole responsibility of the prize winners. By participating in this Promotion or receiving a prize, Entrants (and in particular, winners) agree to release, indemnify and hold harmless the Sponsor, the Administrator, Promotion Entities, and each of their respective related companies, franchisees and licensees, and all of its respective companies’ officers, directors, employees and agents (collectively, the “Released Parties”) for any liability, injury, death, loss or damages to Entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Promotion (or related activities) or the acceptance, possession or use/misuse of a prize (including any travel or activity related to the prize, if applicable). Sponsor is not responsible for any typographical or other error in the printing of an offer, administration of the Promotion or in the announcement of the prize. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor. If, for any reason, the Promotion cannot be run as planned, Sponsor may disqualify any suspect entries or individuals from the Promotion and any promotion it sponsors and (a) suspend the Promotion and modify the Promotion to address the impairment, then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.

- RELEASE, PUBLICITY: Except as otherwise prohibited by law, by participating and/or accepting prize, Entrants and winners grant permission to use his or her name, address, likeness, photograph, video recordings and statements to Sponsor and its respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies for advertising/publicity purposes in any and all media, worldwide, without further compensation or notification.

- VERIFICATION / DISQUALIFICATION / VOID ENTRIES: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. SPONSOR SHALL SOLELY DETERMINE ANY FORM OF VERIFICATION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIBIGILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS, AFFIDAVITS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON MAY BE DEEMED A DEFECTIVE ENTRY AND VOID. A potential winner will be disqualified and an alternate potential winner may be selected (i.e., the person with the next most points) if (i) he/she does not comply with these Official Rules (or is otherwise determined to be ineligible), (ii) he/she does not respond to the prize notice as instructed or is returned as undeliverable, or (iii) the prize is undeliverable for any reason. If Sponsor notifies, or seeks to deliver a prize to or otherwise attempts to contact an alternate potential winner, and such alternate potential winner is subsequently disqualified, then Sponsor shall use its reasonable business judgment to determine, in its sole discretion, the disposition of the prize (e.g., may choose another alternate potential winner in a manner consistent with these Official Rules or donate the prize to another entity, or not award the prize, at its sole discretion). Use of any automated system (e.g., robots, automatic, macro, programmed or like entry methods) or submission of multiple entries is prohibited. Any attempt by any Entrant to use an automated system or to obtain more than one (1) entry per Tournament by using multiple/different email addresses, identities or any other methods, will void all of that Entrant’s entries, and render that person ineligible to receive any of the prizes. Entry materials/data that have been tampered with or altered are void.

- DISPUTES/CHOICE OF LAW. Except where prohibited, each Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in the state of Alabama; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iii) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (iv) Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. Alabama law, without reference to Alabama’s choice of law rules, governs the Promotion and all aspects related thereto.

- PRIVACY: As a condition of entering the Promotion, each Entrant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties, including Administrator, for the purpose of administering this Promotion and to comply with applicable laws, regulations and rules, including, without limitation, the storing of your personal information for purposes of complying with state record retention requirements. Any information Entrant provides to Sponsor may be used to communicate with Entrant in relation to this Promotion or on a Promotion winner’s list.
